2. Zwecke der Verarbeitung und Rechtsgrundlagen

Bearbeitung Ihrer Bewerbung und Auswahlentscheidung. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO (vorvertragliche Maßnahme auf Ihre Anfrage hin) — Sie haben die Bewerbung selbst eingereicht, um gegebenenfalls einen Teamfahrervertrag zu schließen.
Freiwillig mitgeteilte Zusatzangaben (z. B. Links zu Ergebnissen oder Kanälen, ausführliche Motivation) verarbeiten wir auf Grundlage Ihrer Einwilligung nach Art. 6 Abs. 1 lit. a DSGVO.

3. Welche Daten wir erheben

Stammdaten: Vor- und Nachname, Geburtsdatum, E-Mail-Adresse, Mobilnummer, Anschrift, Land, Korrespondenzsprache
Bei Minderjährigen: Name und E-Mail-Adresse eines Erziehungsberechtigten
Fahrzeug und Renneinsatz: Hersteller und Modell, Renneinsatz, bestehende Sponsoren, Team- oder Clubzugehörigkeit
Freitextangaben: Motivationstext, Links zu Ergebnissen, Videos oder Profilen
Shop-Konto: E-Mail-Adresse eines bestehenden Kundenkontos, falls vorhanden
Einwilligungen: Bestätigung dieser Datenschutzinformation und Kenntnisnahme der Leistungs- und Bonusordnung, jeweils mit Zeitpunkt

4. Pflichtangaben und freiwillige Angaben

Die im Formular als Pflichtfeld gekennzeichneten Angaben benötigen wir, um Ihre Bewerbung überhaupt bearbeiten zu können. Ohne diese Angaben können wir Ihre Bewerbung nicht in die Auswahl aufnehmen. Alle übrigen Angaben sind freiwillig und wirken sich nicht nachteilig aus, wenn Sie sie nicht machen — mit Ausnahme von Angaben, die für die Auswahlentscheidung selbst relevant sind (z. B. Renneinsatz).

5. Empfänger der Daten

Innerhalb des Betriebs: Thomas Rößle sowie eine feste weitere Person, die bei der Sichtung und Auswahl unterstützt. Beide sind auf Vertraulichkeit verpflichtet.
Der Anbieter der Formular-App (Shopify) als Auftragsverarbeiter im Sinne von Art. 28 DSGVO, ausschließlich zur technischen Entgegennahme und Weiterleitung der Formulardaten. Der Auftragsverarbeitungsvertrag besteht: Shopify stellt ihn als Data Processing Addendum bereit, das nach dessen Ziffer I durch Verweis Bestandteil der Shopify-Geschäftsbedingungen ist (Fassung vom 25. Juli 2025). Die Daten werden überwiegend bei Shopify Inc. in Kanada verarbeitet; für Kanada besteht ein Angemessenheitsbeschluss der EU-Kommission (2002/2/EG). Zuständige Aufsichtsbehörde für Shopify im Europäischen Wirtschaftsraum ist die irische Datenschutzkommission.
Eine Weitergabe an sonstige Dritte, insbesondere zu Werbezwecken, findet nicht statt.

6. Übermittlung in Drittländer

Der Anbieter der Formular-App verarbeitet Daten auch außerhalb der Europäischen Union und des Europäischen Wirtschaftsraums. Die Verarbeitung findet überwiegend in Kanada statt; für Kanada hat die EU-Kommission mit Beschluss 2002/2/EG ein angemessenes Datenschutzniveau festgestellt. Für Übermittlungen in andere Drittländer ohne Angemessenheitsbeschluss gelten die EU-Standardvertragsklauseln nach dem Durchführungsbeschluss 2021/914 vom 4. Juni 2021.

7. Speicherdauer

Kommt aufgrund Ihrer Bewerbung kein Teamfahrervertrag zustande, löschen wir Ihre Bewerbungsdaten spätestens 12 Monate nach Abschluss des jeweiligen Auswahlverfahrens. Kommt ein Vertrag zustande, gelten für die weitere Verarbeitung die Regelungen des Teamfahrervertrags und der dortigen Datenschutzinformation.

8. Automatisierte Entscheidungsfindung

Für die Sichtung vieler Bewerbungen verwenden wir intern eine rein rechnerische Sortierhilfe (Punktzahl aus Renneinsatz, Referenzen, bestehender Teilenutzung, Vorjahreshistorie und weiteren Angaben). Diese Punktzahl trifft keine Entscheidung und hat keine Rechtswirkung Ihnen gegenüber. Die Auswahlentscheidung trifft in jedem Fall ein Mensch. Es findet keine automatisierte Entscheidungsfindung im Sinne von Art. 22 DSGVO statt.

9. Minderjährige Bewerber

Sind Sie zum Zeitpunkt der Bewerbung noch nicht volljährig, bitten wir zusätzlich um Name und E-Mail-Adresse eines Erziehungsberechtigten. Das dient ausschließlich dazu, im Fall einer Zusage die für einen wirksamen Vertragsschluss nötige Mitwirkung der Erziehungsberechtigten nach §§ 107 ff. BGB erreichen zu können.

10. Ihre Rechte

Sie haben nach Maßgabe der gesetzlichen Voraussetzungen das Recht auf Auskunft (Art. 15 DSGVO), Berichtigung (Art. 16 DSGVO), Löschung (Art. 17 DSGVO), Einschränkung der Verarbeitung (Art. 18 DSGVO), Datenübertragbarkeit (Art. 20 DSGVO) sowie Widerspruch gegen die Verarbeitung (Art. 21 DSGVO). Eine auf Art. 6 Abs. 1 lit. a DSGVO gestützte Einwilligung können Sie jederzeit mit Wirkung für die Zukunft widerrufen.

11. Beschwerderecht

Sie haben das Recht, sich bei einer Datenschutz-Aufsichtsbehörde zu beschweren. Für uns zuständig ist das Bayerische Landesamt für Datenschutzaufsicht, Promenade 18, 91522 Ansbach.

2. Purposes and legal bases

Processing your application and making a selection decision. Legal basis: Art. 6(1)(b) GDPR — steps taken at your request prior to entering into a contract. You submitted the application yourself with a view to possibly concluding a team driver contract.
Additional information you provide voluntarily (for example links to results or channels, a detailed motivation text) is processed on the basis of your consent under Art. 6(1)(a) GDPR.

3. What data we collect

Basic data: first and last name, date of birth, e-mail address, mobile number, address, country, preferred correspondence language
For minors: name and e-mail address of a parent or legal guardian
Vehicle and racing data: brand and model, racing level, existing sponsors, team or club membership
Free text: motivation, links to results, videos or profiles
Shop account: e-mail address of an existing customer account, if any
Consents: confirmation of this privacy notice and acknowledgement of the performance and bonus regulations, each with a timestamp

4. Mandatory and optional information

The fields marked as mandatory in the form are needed for us to process your application at all. Without them we cannot include your application in the selection. All other information is optional, and not providing it is not held against you — except for information that is relevant to the selection decision itself (for example your racing level).

5. Recipients

Within the business: Thomas Rößle and one further designated person who assists with reviewing and selecting. Both are bound to confidentiality.
The provider of the form app (Shopify) as a processor within the meaning of Art. 28 GDPR, solely for the technical receipt and forwarding of the form data. A data processing agreement is in place: Shopify provides it as its Data Processing Addendum, which under its section I forms part of the Shopify terms of service (version of 25 July 2025). The data is processed mainly at Shopify Inc. in Canada; the EU Commission has issued an adequacy decision for Canada (2002/2/EC). The competent supervisory authority for Shopify in the European Economic Area is the Irish Data Protection Commission.
No disclosure to any other third parties takes place, in particular not for advertising purposes.

6. Transfers to third countries

The provider of the form app also processes data outside the European Union and the European Economic Area, mainly in Canada, for which the EU Commission has found an adequate level of protection (decision 2002/2/EC). For transfers to other third countries without an adequacy decision, the EU standard contractual clauses under implementing decision 2021/914 of 4 June 2021 apply.

7. Retention period

If no team driver contract results from your application, we delete your application data no later than 12 months after the relevant selection process has been concluded. If a contract is concluded, the provisions of the team driver contract and its own privacy notice apply to any further processing.

8. Automated decision-making

To review a larger number of applications we use an internal, purely arithmetic sorting aid (a score derived from racing level, references, existing use of our parts, history from previous years and further details). This score does not make any decision and has no legal effect on you. The selection decision is always made by a human being. No automated decision-making within the meaning of Art. 22 GDPR takes place.

9. Applicants who are minors

If you have not yet reached the age of majority at the time of your application, we additionally ask for the name and e-mail address of a parent or legal guardian. This serves solely to be able to obtain the involvement of the guardian required for a valid contract under §§ 107 et seq. of the German Civil Code should your application be successful.

10. Your rights

Subject to the statutory conditions, you have the right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), data portability (Art. 20 GDPR) and to object to processing (Art. 21 GDPR). You may withdraw consent given under Art. 6(1)(a) GDPR at any time with effect for the future.

11. Right to lodge a complaint

You have the right to lodge a complaint with a data protection supervisory authority. The authority competent for us is the Bavarian Data Protection Authority (Bayerisches Landesamt für Datenschutzaufsicht), Promenade 18, 91522 Ansbach, Germany.
